The City of Davenport, Iowa is accepting bids for beet juice-derived liquids for anti-icing and pre-treatment of roadways for the 2022-2023 winter season.

This is a requirements-type contract where there is no guarantee of the actual quantity to be purchased during the term of the contract. Except in the case of delivery timing, product efficacy, or product compatibility noted below, if the City has a requirement during the contract term the awarded vendor will receive the City’s order for the product.

The estimated quantity to be required during the term of the contract is 30,000 gallons with an anticipated range between 10,000 and 50,000 gallons.

Question Would the Purchasing Department accept this alternative to item 12 in the General Instructions to Bidders:
12. Awards of bids may not be assigned to another vendor without written authorization from the Purchasing Division, "except that, upon notice to the Purchasing Division, Vendor may assign an award to the successor to all or substantially all of Vendor’s business or assets, provided that the assignee agrees in writing for the benefit of the Purchasing Division to be bound by all terms and conditions of the award." Vendors are responsible for all acts and performance of any "assignees or" subcontractors and secondary suppliers, including full responsibility for their direct payment. Failure to meet terms and conditions of an awarded bid authorizes the City Purchasing Division to purchase the items or services elsewhere and charge the full increase of cost to the defaulting vendor.
