NOTICE OF HEARING

NOTICE OF PUBLIC HEARING FOR CONSIDERATION OF A THIRD AMENDMENT TO THE GROUND LEASE AGREEMENT WITH TOWERCO FOR THE EXTENSION OF LEASE TERMS OF WIRELESS COMMUNICATION FACILITIES IN SUNRISE PARK AT 5414 EAST OAKWOOD DRIVE IN THE CITY OF PLEASANT HILL, IOWA.

Public Notice is hereby given that at 6:00 p.m. on the 13 ^th day of February , 2024 the City Council of the City of Pleasant Hill, Iowa will, in the Council Chambers, City Hall, 5160 Maple Dr. Suite A, Pleasant Hill, Iowa, hold a hearing whereat said Council will resolve to consider a third amendment to the ground lease agreement with TowerCo for the extension of lease terms of wireless communication facilities in Sunrise Park at 5414 East Oakwood Drive and, at the time, date and place specified above, or at such time, date and place as then may be fixed, to act upon approving said amendment..

In October 2016 the City Council approved a ground lease agreement with TowerCo for the construction of a new 190’ tall monopole adjacent to the water tower for five years, with the right to extend the lease for four (4) additional five (5) year terms, terminating on May 20, 2043.  TowerCo is requesting to extend the lease for eleven (11) additional five (5) year terms, with the final expiration date of May 20, 2078.

At said hearing, the City Council will consider the third amendment to the ground lease agreement with TowerCo for the extension of the lease for eleven (11) additional five (5) year terms, with the final expiration date of May 20, 2078 of their wireless communication facilities in Sunrise Park at 5414 East Oakwood Drive, the same now being on file in the office of the City Clerk, reference to which is made for a more detailed and complete description of the proposed amendment, and at said time and place the said Council will also receive and consider any comments/objections to said amendment made by any interested party.

This Notice is given by order of the City Council of the City of Pleasant Hill, Iowa.
